I've heard that to be "legally separated", all you have to do is move out of the marital household and write the date down. I've also heard that if you change your address after doing so, you are considered as being legally separated. My friend "Cass" wants to 'file' for separation--is there such a thing, or do you just leave the person?

You're right-- your friend doesn't need to do anything to be separated. She can see an attorney to have a separation agreement drawn up, however. It defines the terms of the separation between the two parties, including division of property, child custody or anything else relevant to the individuals involved. If she and her husband sign it, the divorce proceedings will be very simple; just two signatures on some paperwork. In most states, she will be eligible for divorce one year and one day after the date of separation.

That is all incorrect unfortunatly. Legally Separation is the same process as a divorce. It has to do with what state you were married in as opposed to the state your getting a divorce or separation in. For example, if you marry in CA, you can file for divorce only in CA, whereas you can only file for legal seperation in every other state. Hope this helps

No there is such a thing my fiances parents went through this and she ended up moving out of the house and changing addresses and they couldn't be in the same house for 30 days to get this done.Hope this helps!!!!!
