The wooden fence in our backyard is so rotten that it is about to fall down. How is it determined who's fence it is and who replaces it?

To fence or not to fence seems to be based on customs and traditions of a community. Except in the case of swimming pools which often require fencing.

It may be impossible to find out whose fence it is. It could be on the property line and since it is old and in need of repair, no one may want to claim ownership. Why not call it a "good neighbor" fence and try to work out shared responsibility. Finally it may be up to the person who cares the most. Check with you local building department which may have some unique ordinances.

I have never heard of a neighbor having to pay for their share of a fence.......I suppose if all the neighbors want the same fence then they can work something out, but if you and your other two neighbors are the only ones who even care about the fence then you have to pay the bill. If you want a fence you buy the fence. Afterall, it is your property- isn't it? And aout the bushes- since the bushes are on your property line then you have to trim them- regardless of whose bushes they are. you are not getting the response you wanted- I see that-But the fact still remains that it is YOUR problem...... DEAL WITH IT AND MOVE ON...... Nobody has to HAVE a fence if they don't want one. Just because my neighbors get a fence doesn't mean I have to get one too. And if im not getting a fence why the hell would I pay for part of my neighbors????????? Your neighbors maybe getting ready to tear that old fence down and not get another one. Why should they pay for your part because you HAVE to have a new fence? Seriously, think about this- it is a very stupid question.

What state are you in? Each state is different. If you have a pool then you are responsible. If you have a dog you might be responsible. If there is no legal reason that requires either of you to have a fence then you would split the cost. If you want a fence and your neighbor doesn't then you pay. If that happens, then you would set your new fence 8-12 inches inside your boundary. You then would not allow your neighbor to attach his fencing onto yours because it is on your property and not on the boundary.
It's rarely if ever on your deed about fencing.

If it is on the property line you and your neighbor are each 50% liable for the fence. You may have to get a survey if you're not sure where the property line is.

morbidsmi got it backwards.In the US the finished side faces the neighbors and the actual fencing - stakes, slats. chain link whatever should all be on the owners side of the property

if the owner does not have to replace it if they do not want to unless it is a city ordinance to replace eyesore realestate and land.

if you can afford it then offer it to the landowner that you'll share some of the cost of replacing it if it bothers you that much.

i'm sure your sanity and peace of mind is worth more than the fence is worth

Most likely it is not on the line, but on one of the properties. Look at the survey of your property and you should be able to figure it out. your local zoning board will be able to help.

who has the finished side on the fence, you know the side that you don't see the posts. if the finished side faces you its your fence, if you see the posts its your neighbors, however, if both sides are finished, then it may be county or zoning bored owned

Look on the deed: on my deed it is clearly listed who is responsible for what.

Deeds (titles) can be gotten by "doing (=paying for!) a title search from a Title Search Company (in phonebook or all realtors who want to sell houses (!) will know at least one!)

if fence is on your property you would pay,if it is on your neighbors property they would pay unless you both agreed to share cost.if it is dead center between properties(exactly on property line as determined by survey)you would share cost.
