My parents are wanting to buy a house that have three oak trees on the land. The problem is, a lot of realtors told my parents that buying a house that has oak trees can be a bad thing. Something about overgrowth and uprooting the house (Exaggeration of course). Plus, they don't like how the oak trees look anyways.

So my question is, is it legal to get them removed? I live in the state of California and I have tried looking for the laws regarding oak trees but I couldn't find any. They aren't that big and removing them shouldn't be that big of a problem, but I was just curious on what actions my parents have to take to have the oak trees removed.

If I were you (or your parents) I would find a new realtor. Studies have shown that mature trees can add as much as 20% to your property value and can save you money in energy costs as well.

Oak trees grow into very large trees, so it may be advisable to remove 1 or 2 depending on their situation. If you think there's enough room for them all leave them.

I think I would look for more intelligent Realtors, everyone knows sensibly planted large trees add thousands to the value of your the property. Go to any city and check out the most expensive suburbs, they're always the ones with the large beautiful gardens full of trees.

Sun baked blocks with a few beds just don't have the same appeal. If you live in a hot climate you can't beat the lower temperature a large tree provides (up to 15 Deg F cooler under the tree).

In most locations of California, there are no restrictions on removal of trees from personal property. There are no statewide regulations preventing oak removal. Check with the city/county planning department for any special local restrictions.
However, there are thousands of oaks very near homes in many places in California, including my house. If the area near the trunk is not irrigated, they are pruned carefully by a trained arborist and other wise left alone, they should not be a problem. Surface roots are not common problems with oaks and are rarely a cause for structural damage.

And you actually believed that idiot?! Oak wont harm the house for at least a hundred or more years unless the roots are within a few feet of the foundation. Oak are beautiful stately trees and your parents are right to want them. leave the trees, or just dont buy the house. Some one else will buy it and treat them the way they should be treated, and they will get decades of great shade from them

I have a 150 year old oak tree 10 feet from my front room. It has not hurt my house at all. If you really want to remove your tree then hire a tree cutter to cut it down for you.

1. TREES causing problems are MYTHS that stupid people make up.

2. NO TREES are ugly, and oak trees are beautiful!
3. You need to be a real bastard to cut down trees JUST BECAUSE YOU DON'T LIKE THEM..,tell your parents this: "do you think it would be fair if your neighbor killed you, simply because he didn't like you?"

DO NOT GET THOSE TREES REMOVED --- ONLY BASTARDS DO THAT

Contact your local building dept.I lived in so. Cal. and the species Live Oak Were in question unless a hazard or disease was present
