iwant to break my lease because my landlord doesnt fix anything. my childrens bedroom dosent have heat and my slimlord tells me to switch bedrooms with them. theres just storm windows no real windows, 2 huge holes in the yard from them digging for the sewage, floors caving in and he tells me to put a board over it!! i wrote a list of things that were wrong when i first moved in a year and a half ago and NOTHING is fixed. any advice would be grealty accepted- i just want out i dont care if he fixes them or not i just want out-NOW!!!!! do u think if i threatened to report him he'll just release us of the lease? thanks

If you can prove that the home is in a "unliveable condition" then you might be able to get out of the lease. Ask the county you live in for advice. Have them send out a building inspector to check the residence.

I just got out of a nasty lease with a landlord who was constantly watching my house and telling me I had too many friends and I need to keep shampoo bottles out of the bathroom window sill. I was unhappy there until I discovered that she failed to put a term on my lease (she wrote when it started, but not when it ends). there was my out.

I suggest that you speak with building inspectors and contact someone familiar with property rights. and check your lease, a lot of times landlords will buy the "legal" documents from Office Depot and fill them out, leaving out valuable info. sometimes the landlords do not know squat about renters rights.

Of course you can but you have to report the conditions to your local housing people either city or county. Call a librarian and ask the question. It is also online - do some work for yourself. If what you are saying is true you don't even have to pay the rent, but you do have to deposit it safely as you go to court. Small claims can handle it I believe. Online you can file anything in small claims and superior court. Do your own homework and stop being a victim. Even child protective services would intervene and order you out. Do you not investigate things that affect you and your children?

There are certain building codes landlords have to live by...if he does not do these things than by law he is in default of your legal contract.....just as if you didnt pay the rent he could take you to court, Because you would have been in default of the same contract. Plus you say you have children living in the home....almost all states have laws the housing provided for them be up to code no matter what. He and you (as a parent)have to follow these laws or risk further actions by the law. Dont threaten him, Turn him in, Hes putting you and your childrens lives in danger. Do it now.

I honestly would talk to a lawyer who specializes in these things so you can find out if you have any legal options. If you do end up breaking the lease, you may be forced to forfeit the security deposit. Read the lease you signed!

Don't just threaten him with turning him in, do it! You will save the next tenant the misery you have gone through. He wont have a choice to terminate your lease if the county, or city comes in and shuts the place down and condemns it.... Right?

I would do just that...tell him you want out of the lease or you are going to turn him into code enforcement, then do it.

I suppose it depends where you live too...if your in a city they probably have pretty strict codes...some of those smaller towns don't have as strict of codes. If you don't care about your security deposit just leave and take pictures in case you wind up in court.

i'm not an attorney or a law expert but i beleive you can, you have to prove he is a slumlord first...i'd get some proof and then threaten him with court and tell him you'll drop it if he will drop your lease, chances are he will let you out because then there could be legal charges and crap he doesnt want messing with him

Yes you can on the grounds of his failure to live up to his end of the lease. He is required by law to upkeep the residence and if living conditions are as bad as you describe then you should leave and report him as well. Get your kids out of that mess.

Well, have you notified him in writing about those repairs. I hope you have the copies if you didd....Let's say you di not....Send him another letter giving him a short, but doable deadline. and those repairs have to be to your satisfaction and if he does not comply and most likely he won't than you will have a leg to stand in court.

Don't threaten, do it. Report his sorry ***. There is no reason for you to be living like that.
