I'm sorry to say I honestly think he would lose. Unless they have been at least legally seperated during this time, your pregnancy will be used against him. Also it would all depend on if she can at all be seen as being an unfit mother. To a certain extent if you were not pregnant and you were getting married it may help his case with getting his son because him being military would bring the necessity of someone to watch his son if he went away. He may stand a slim chance, if it was New York I would say flat out no. If there is a real good reason for him to have custody over her than you owe it to the child to try to get custody.

Yeah he can get custody. I'm from Ga and I know quite a few guys (both military and civilian) that got their kids. If he thinks he's the better parent he should spend whatever he needs to to get his son.
On a side note though...you might want to think again before ever messing with a married guy no matter what the circumstances are. Until the papers are signed he's still married and you should stay away.

Sounds like he lied to you to get full custody. This happens when one person has a good lawyer and the other has a bad one or none at all. He can say anything he wants, lie or true and his lawyer can type it up to make it look official. And then they can tell you any lie they want to get you to sign it. This happened to me once. And his lawyer told him exactly what kind of lies to tell me so I would. I feel really bad for you ... if you can afford to talk to a lawyer now I suggest you do so. If you can't ... well, this is a lesson for you :( Sorry you had to learn it this way. ... Okay, I don't understand that. But I would still say you shouldn't sign away custody of your children. Still sounds like he lied to you. Get yourself a lawyer if you can.

yes a military father can get full child custody.... the definitive factor of course is what is best for the child's interest... but as long as there is no compelling factor to take away a child from his mother, the court, i think, would most probably favor the mother

That child needs to be with his mother, epecially if you cant respect that she is his mother. Are you going to cuss about her in front of the child? How old are you 12? Respect goes a long way, especially in court.
