Ok this is something I have been very curious about for a while. I have an example before I give the question.

If I was to have a wireless LAN up and running, broadcasting an SSID, but I left the network UNencrypted, yet having some type of MAC address logging software installed on the router...

If someone came buy and started downloading illegal content, who would be at fault. The person providing the unencrypted internet access, or the person downloading the illegal content (whose mac address was recorded, AND NOT SPOOFED).

This question is about not me, please don't e-mail with any hate mail or for any other reason other than to answer the question.

Also say I have a packet analyazer installed on the router, and I can prove HE downloaded it.

i would say that the person doing the illegal act is at fault ....(why we block ports, granted thats easily fixed with some finesse. )

thing is here ask yourself this question:

the gov't provides freeways, people speed on those and in worst case scenario's people die. does this mean the gov't should be held responsible for these irresponsible people and blame them(gov't) for constructing these freeways?

You'll have no fault at all, only the PC in which the illegal content is downloaded to has done wrong. This is trackable by the forensics team when they confiscate the piggyback-er's PC.

About not securing your network access, it's totally not your fault. They can't possibly blame you for that. Just take this for example, does not locking your house means intruders can come in and do whatever they want? You're the owner, you decide whether to lock or not, and no one can blame you for letting intruders in because it's logically incorrect. It's not as if you want them to come in.

No matter how secure is your network some one can use it if they have the time and knowledge.
But if some one Cross your network and mascaraed the mac add.....as an investigator......hum! Probably you or whose mac address was recorded, AND NOT SPOOFED all depends on the forensic studies in your PC. And some hackers use others PC's to hide files, specially porno......
Anyway your PC will be confiscated and studied and you will be under a lots of eyes and with a very expensive lawyer. So beware!!!!!!

The person using your network is at fault. Legally he is trespassing on your network and can be found guilty. There was a case recently in the news.

my guess would be the person silly enough to not control the access to their wireless. it's easy to encrypt your wireless network, or to limit access to certain mac addresses. if you don't do it, then i guess you're to blame that anything that happens on your access. course if you logged the mac address, that may or not help any authorities trying to track down the person. easy enough to change your mac address if you want to.

the fault would be of the internet owner. It is your responsibility to control the usage of your internet connection.
