My husband and i are going through a divorce. He has been gone since the middle of april. We have had no contact since then. Can we file taxes seperately? We have no children together and we had nothing that we bought together. It was basically like we were married but doing everything on our own.

Yes. There is a selection you can make called "Married Filing Separately". It usually means paying a little more in taxes, but there's nothing you can do about that now.

Been there lived that. IRS says to be able to file Single you have to be legally separated (my state does not DO that) or have a divorce in the court system already.

Otherwise- you can file married filing separate which is the HIGHEST tax bracket of all. See the IRS encourages all married folks to file joint, to get bigger refunds.

But if you do....you are on the line for whatever tax fraud they've done if he's ever caught.

Say he hid an extra income from you & you never knew. But the IRS finds it and the back due taxes are $6000. Say he got fired and YOU have a job. You'd be garnished for all of it 'cause it's assumed you had a share in the unreported income!

Pay the high tax rate now & go married filing separate. It's so much safer!

you've 2 selections; Married filing mutually (MFJ) and Married filing one after the other (MFS). The later is under no circumstances a reliable theory. you're prohibited from filing HOH in case you lived jointly any time contained in the terrific six months of the three hundred and sixty 5 days. The farmer element will make your go back slightly extra complicated yet you should nonetheless get the same or more desirable refund if his farming interest change into at a loss. you should work out a tax specialist as they are going to in all danger avert extra funds than they charge.

Read the section in the IRS book regarding filing status. I would be concerned if you file jointly because you are both and separately liable for any money owed.
