is on the property as owner alone. she conducted business on his behalf. she got in terrible debt. into my 2nd month of the lease she gave me a verbal agreement to pay late. she called my mothers house and i got into a verbal argument with her i told her i would be coming home and we could finish the discussion she told me to shut my mouth and listen to her i hung up on her. when i got home she gave me an eviction stating move out i cannot work with you any longer. not that i was late but that she couldnt work with me. this breaks the agreement. then i tried to contact her and sent cert. letter to have her rent sent to her or i could hand deliver it. the letter was picked up by her husband and i heard nothing at all till the lawyer contacted me with a 3 day eviction then it went to court .first she broke the contract and then wouldnt accept my payment or call or talk to me. now she left the country three days before court and i also had a change of the justice of the peace for fairtria

do you think i have a case or not can she not show up and leave it all to her husband? does not sound legal

yea im real racist ufo. im native american indian and i was promised to be able to stay here for a year. you dont throw someone out for hanging up on you and break a 1yr lease. its a motel and i live in the living quarters. where do you go when something like this happens. my brother got murdered in june and mother with a kidney transplant. and i am single and trying to care for my grandchildren. i suppose you have the perfect life. hurray for you. this is all unexpected and turned my life upside down. i tried to pay her but she would not accept it. she wants to still tell me what to do in my business but she leased it out to me. all she had to do is sit back and rec. the rent. she went back on her word and broke the lease from a temper tantrum and i stood my ground. i will have my day in court tomorrow and let you know how it went. yes i have a problem with this piticular phillipino woman coming here and doing this. maybe one will get your husband one of these days and what will you d

ATTENTION: I just looked at your questions on your profile and saw that you have been asking about this for 2 months. Also you seem to have issues with filipino women. How long are you going to live on that lady's property against her will? And it is about time you got over your racist attitude. Also, I saw that you want a free camper to live in with 2 children. Maybe you need to consider social services if you can't keep a home for the kids. You say you are their grandmother - are their parents out of the picture? You need to think about what is best for the kids. It is understandable that you cannot support them, so why not try to find them a stable home?

I am trying to figure out what the "marriage for visa" has to do with this situation. Was she deported? I am confused as to how this affects your situation.

Also, how is her debt connected to this? Are you thinking that she plans to sell the property?

With that aside, you need to read the terms of your lease agreement. Can she terminate the lease with a certain number of days notice?

As far as the name on the property, if they are married she can conduct business on his behalf. He is the only one who can take issue with it if they signed a prenup. So, yes she can leave it all to her husband and not show up. She can leave it all up to a lawyer or to her best friend's 2nd cousin for that matter. Your legal representative does not have to be an attorney.

I think you need to read over your lease carefully to see what it says.


Additional: I guess this person does not realize that Native American Indians can be racist. After all they are humans like everyone else. And I know for a fact that I never said whether or not I am married...but I will say that my sister in law is from the Philippines and I just don't see what the problem is with Filipino women. She is very intelligent and caring, a good mother and a good wife. Why would it matter that she is from the Philippines instead of somewhere else? lol

Unless you live in California, I think you've got a problem. If you were late on the rent at all she can file to evict. California has the best laws to protect tenants in the country, but the rest of the country, it's all slanted towards the landlord. You can contact the housing authority in your city and ask, but it sound to me like you need an attorney or a new place to live. Sorry, hope everything works out OK for you.

If you are in New Jersey, you may be in luck. It is nearly impossible to evict someone here. Your state may have similar laws. I would google "tenant law" and your state and see what you come up with.
