if both parties of the plaintiff dont show up can it be dismissed. only the Mr. is on the property ownership papers not the ms. and she has left the country. if she wrote the lease and was over it how can he now step up and do anything if he does not know what is going on.

i tried to pay but she would not accept it and kept telling me get out she couldnt work with me. then she stopped all email and accepting phone calls etc. i tried to pay

The landlord can send anyone she wants to represent her. This includes a lawyer or whomever she chooses as her legal representative.

Aside from that, her husband should naturally be assumed to know what is going on, since at least the income, and maybe the property also, belongs to both of them due to the marriage.

I have did this many times for my mom, as it is a simple procedure to go to court as the plaintiff in an eviction. If they want you off the property why don't you just find another place to live? Honestly, you say she is letting you leave without paying so why not be thankful for her generousity and just leave?

Chances are he has Power of Attorney, and documentation that she is no longer in the country, and he can handle her affairs. The courts will decide if the eviction is valid. If this is a non-payment of rent situation, you might as well just find some place else to live...and QUICK.....having the county sheriff come out and put you off the property, can be quite humiliating and they'll not give you the time to gather your belongings.....

Sorry to be the bearer of bad news, but you're not going to get that one to fly in court. As long as its her husband he has the right to represent her interests in an eviction proceeding. You don't say why you're being evicted, but you can buy yourself some time by filing an answer to the eviction notice. They will then set it for a hearing, usually about 2-3 weeks down the road. I know that won't really help, but it will buy you some time to find a new place to live.

No, as long as one of them shows up, then the court can proceed. The mrs will not be allowed to testify and anything she said cannot be used by since it would be hearsay.
