It depends on which stat I guess.....best thing to do is to get a living will that will give the domestic partner those rights.

There are some states that recognize living together as legal after a certain period of time.

However if the other partner gets a good lawyer the other partner may get zero.

I am not sure on this one, but I believe it depends on the state they are residing in. Every state has different laws on that.
I live in Florida and I assure you that here the state does NOT acknowledge Common Wealth marriges. One of my friends was living with her bf for 7 years here in Fl and when he passed away she got nothing cause they were not married and his family did not like her.
You could find out by calling your local Legal Aid services and getting advise.
