If so, I want to know the exact legal principle involved. I'd like to hear from legal experts: are you a lawyer?

I know a lot of you feel strongly that Padilla should be punished harshly, and you don't care much about his treatment in custody. However, I'm looking for a technical legal answer, not your opinion on what should happen to Padilla. Thanks.

Not a legal expert, however, I hold firm that the charges against Padilla should not be dropped, but further investigated and brought to trial.

As for the less than human treatment he received while in the SC brig, those involved should be brought before a NON military court as well as a military tribunal.
