It would be difficult to convict Hitler in a modern U.S. court. Although every one (except red-neck idiots) knows he was largely responsible for the atrocities that took place, he never killed anyone himself, nor did he ever directly order anyone killed. It's a little bit like a mafia movie. When Don Fettucini asked Vinnie to "take care of it", did he mean he wanted Vinnie to kill Tony, or buy him an ice cream cone? We know what Hitler's implications were when he spoke of the "final solution", but it would be hard to prove legaly.
That's one reason I hate our modern justice system. It lets far too many people everyone knows is guilty go free on technicalities, etc.
