its tropical fish with heater and light, where are the flies coming from. and we have no plants near , and everytime we get rid of them they come back!

I'm surprised the fish don't eat the flies.

The obvious one is to keep the tank as clean as possible.
Flies are usually attracted to stagnant water (still water) so I wonder whether you have a filter? The heat of the lamps causes algae to grow on the glass, and this will also attract the flies.
You cannot use fly or pest spray to get rid of them because this will be harmful to the fish.

I assume you have a lid for the tank. If not, get one and try to keep it as sealed as possible to stop the pests getting in and keep the area above the water as clean as possible. Just use a cloth to wipe away any algae build up on the glass and the underside of the lid.

You can make a simple fly trap by putting about an inch of cider or beer in a glass, putting a plastic seal on the top and punching a few holes in the seal. Put this next to the tank and the flies will get in but won't be able to get out so are easy to dispose of.

But, really, the simplest method is good aquarium hygiene - try to change half the water every two or three weeks depending on how clean/dirty it looks, and make sure you have a filter that is adequate for the tank. With a good filter you can minimise the cleaning to once a month.

Do a full water change every three months or so, and your fish should be happy.

And whatever you do...
... never use chlorine to clean the tank...

You may want to keep the tank clean. Go dump the filthy swamp water out in your back yard or grass somewhere, the green little flies should come out and fly above the puddle. If there are still some in the tank, rinse it with warm/hot water while still outside, then use the cleaning solution, chlorine, etc. and fill up the tank as you normally would, gently rinse the fish with a smidge cooler than lukewarm water to clean the sludge off of them as well and put them back in the tank. If the flies still return, look at the surrounding areas and the room the tank is in, ask yourself is it cleaned regularly? Then clean and dissinfect your whole house because it doesn't make sense to have one ultra clean room and the others remain filthy.

If this doesn't work, you can't beat 'em so join 'em, and just name your new involuntary pets!

I would do a 50%water change and get as many of the bugs as possible.

I think maybe dirty water is attracting them. If not then I'm not sure whats going on!
