Five years ago I married an American citizen in Alabama, the marriage became so frought with violence that I had to return home to England, we haven't spoken in a year and I know that he wouldnt consent to a divorce. I didnt have a visa to live in America throughout the time I was there and did not myself become a citizen. Is there any chance at all that the marriage isnt binding here in the uk? and if binding, how long is it going to take me to get a divorce without his agreement? please help

Being married is world wide. You can't leave the country and not be married. Get a lawyer and get a divorce. Hopefully you woere'nt the violent one. Good luck.

The marriage IS BINDING. That's the bad news. The good news is that if you've been living apart for more than a year the chances that you can get a divorce or an annulment, has substantially improved. The lack of joint citizenships, & the great distance are also factors that can work in your favour. Plus your reasons for leaving him in the 1st place.
Consult a divorce lawyer in the U.K, & get the ball rolling if you want to end it ASAP.

There is a way to advertise in the US papers that you are applying for a divorce. If he doesn't read the paper and respond by a certain date, the divorce can go on without his consent. Seek Legal action and find out for sure. You may have to travel back to the US but it's worth the trip to be rid of him for good.
