I bought a car from a car lot and they said they would fix a certain mechanical problem. Four months later, I found out that their mechanic never fixed it and took off and is missing. They said I have to go after their mechanic, but I don't think that is correct. Aren't they responsible to fix what they said they would fix.

The mechanic worked for the car lot so the car lot is responsible. If they are sending you after the mechanic, this place is not trustworthy.

Check the agreement. If it was verbal, you are probably out of luck. If it was written, the dealership is responsible. Normally your agreement would be with the service department of the dealership and not with a specific mechanic.

If the agreement is indeed in writing, consult a lawyer. Usually a simple letter or phone call from a lawyer or law firm will do wonders for the service a dealership will provide. A decent lawyer will do either for you for under $100.

In addition to this, if the problem is serious, get another shop to do the repair after getting several estimates. then have the lawyer send the bill asking for reimbursement. The dealership will usually agree to pay you in these cases too.

At any rate, make sure to tell you friends and neighbors not to do business with this dealership for any reason. They sound like bad news.

If you bought the car from them they have to make sure it is of merchantable quality therefore they are responsible unless you bought it with declared known faults.

they have to fix it your contract is with them not there mechanic .........small claims court will enforce this one
