There is no law restricting criminals from entering politics therefore no loophole, but there are some states that do not allow felons to vote. It is possible for a criminal to run for office but not be allowed to vote for themselves. Remember Oliver North ran for senate in Virginia after he was found guilty on three charges (the conviction was later vacated).

A few of them that i could think of>>
a) Indian law, being a duplication of the Irish law mostly, has adopted the basic assumption also that people are eductaed and democaracy-conscious. lets face it>> humans have this sub-servience instinct, n not many of us would like to live free from a Guard. We uneducated people have greater attitude to be serventile.

b) Indian society operates on different prejudices from that of the originals,ie the Irish. so we need to re-work our laws, may be on their principle only, but for our social n cultural environment.
People in India give more value to their caste, religion, region. so they act or vote in accordance. Thakurs will reinstall 'Raja Bhaiya' nomatter how many murder counts. Yadavs will still vote Laloo n Mulayam. Abu Salem knows Muslims will still vote him to power. Law needs to work this over.

c) Election symbols have been adopted for the benefit of uneducated. No measure taken as yet for thousands of eduacted expatriates to vote their person back at their home, despite all advancements in IT.
