Is it against the law to shoot a dog if u think it is in so much pain that it would be more humaine to kill it on the spot?
What if its not? What if you did not take it to the vet to get it checked out and all it had was arthrits?
Could you be charged with murder, or animal curlety?

It wasn't me but I know a person that did that. I am not sure if they brought him to the vet at all, because their lie made no sence, but they shot him. And I think they should not have shot him at all.

You certainly have a right to be upset. We run a shelter for elderly animals, and I get really torqued about the way people dispose of old dogs when they're no longer convenient.

In most places it isn't murder, but can certainly qualify as animal cruelty. This is also about the guy having other choices, as opposed to the ones who have written to tell you how it is living in rural areas.

If there was a vet close by, then the person should have had the guts to take the animal there. Even if he was dead-broke and couldn't afford the euthanasia fee ($50.00 around here), most vets have a fall-back plan, especially with that many vets in the area. IF it was an elderly dog in obvious pain and discomfort, the vet shouldn't have had any qualms that the man's case was legit (as opposed to him wanting to get rid of the dog because it was inconvenient), even if he'd never seen the guy before.

If he had taken it to the vet, that would have been the humane thing to do. By shooting it in a neighborhood where he had other options, that's animal cruelty.

As others have pointed out, tho.....

Not everyone has the option, or the money, of a local vet. People in the country typically have to take care of their own livestock and pets, and that means putting them down when necessary. Our shelter is in the country, and we have to rely on three vets in three counties for anything we can't handle. When an animal is hurt badly, tho, it IS cruel to make them wait until a vet is available.

How many of the tender-hearted folks here could bear to ride two hours to a vet with a dog with bones sticking out of it's coat? How do you hold that dog? What happens every time you hit a bump? Or can you hold a cat with crushed insides and a shattered jaw, crying the only way it could, for two hours? What's cruel then, folks? Be real!!! .

To conclude, this guy HAD options, so I have no sympathy for a jerk who would choose to shoot an elderly dog if a vet was readily available.

This is a good question - I think. First of all, they (or anyone else for that matter) can never be charged for murder for killing an animal. Murder (legaly speaking) only applies to people. So (legally) you can never murder an animal. For almost every scenario except for the crime of animal cruelty the law treats animals as property - no different than a chair or car. However, animal cruelty is societies way of encouraging humane treatment of animals. In the casa above, he may or may not have actually commited the crime. The police would have to investigate. Maybe there is a law or ordinance in your community that specifically bans the killing of your own animal for humane reasons outside the counsel of a licensed vet. Call your city hall, and check out the link below to find the state statue in your state that would control in such a case as a good starter.

How nice to have a vet right around the corner. Well, guess what, not everyone does!!!

I live in the boondocks. The nearest vet is 40 miles away, and there's only one for the entire county. When he goes home, he doesn't answer his phone. My next option with a terribly injured animal is to bounce down five miles of washboard dirt road, then go another 100 miles to the 24-hour emergency vet clinc in a large town.

What do you think that's going to do to a dog who has been stomped by a horse, run over accidentally by a tractor, eaten poison at a neighbor's, or any number of things that happen in the country? The dog is tortured for another two hours, instead of being humanely dispatched.

We don't have luxuries, like instant vets, out here. If a dog gets hit by a car on a country road and is choking on its own vomit, do I shoot it, or drive it 100 miles to a vet? If I see a rabbit someone has crushed in half with a truck tire and peeled the skin off it, do I shoot it or drive it 100 miles to a vet? If my cat gets attacked by the neighbor's dogs and has been pulled in five different directions, do I bundle her up and take the screaming paralyzed thing to a vet 100 miles away?

And if it's an old dog in a lot of pain, why drag it up to a place where it's scared and nervous, away from home? Think about the animal, not your own feelings. I don't see too many of your answerers being remotely realistic, or responsible.

Well look lady, in the south, we put animals down all the time with a shotgun. Sometimes is more humane to put an animal down right there on the spot than to have to take it to the vet so he can charge you a bunch of money to put the animal to sleep with a shot of his own. By the way, I've never heard of somebody being charged with murder for putting a critter down. Humans are murdered, not animals. Let me guess, if I hit a deer with my truck, should I be charged with vehicular homicide? Does a bird have the right to sue me if I cut down a tree? If you tree-hugging, hippie, animal rights activists have your way it would.

first of all, another garcia is dead wrong... if you shoot a police dog you will be charged with murdering a police officer... also in most citys you are not permitted to discharge a fire arm inside the city, if your to cheap to have him professionally youthinized the poor thing... then give it a healthy dose of zanex and before you know it ,the dog will be asleep and will slowly stop breathing a, peacful and cheap way to put old yeller out of his misery, however their should be signs that the dog is not able to stand or walk right or is constantly yelping in a suffering manner only then should you put him down.

It is animal cruelty. Even if there is a dog in a lot of pain, it doesn't make it any better to shoot it, it should be euthanized. I think the only time that shooting a dog is considered okay is when dogs are attacking a human being.

But these days with all the do gooders out there it is like a capital crime to do it now,

You could be chaged with discharging a firearm within city limits and animal cruelty.

Take the poor thing to the vet and have it euthanized.
