so if it is legal to ask a woman to have sex in the movie I'm producing, for which she will be paid, how is that different from approaching a woman and asking her to exchange sex for money, which could get me arrested for soliciting a prostitute? In both instances I'm asking her to perform sex for money.

There is a fine line between art and prostitution. The is a strong arguement to be made that porn is a form of art, just like any other motion picture, photograph or sound recording. The difference is there is a written contract for porn production. The actors will be paid so much money (sometimes more if the movie sell well) and are doing so of their own free will.

I suppose you could hire prostitutes to make a porno, but you will notice that most of the guys who pay the production costs (the producers) do not get to be in the films.

You can skirt the law this way on prostitution, simply have the woman sign a contract,hire a film crew ...and say its for "artistic appreciation", and call her an "actor" from the onset. . The porn industry currently is a 2 billion dollar a year in sales,
moreover this is really the filming of prostitution glamorized,

Good question. I would love to see this question of yours played out in court. Also, it would be a good story line to a book or movie. The difference is one is for 'film' or freedom of expression ( I guess you can call it art or creative freedom ) the other is,well, just sex. To me, they are the same. I am sure this is true to the actress in the movie and the prostitute turning the trick. So how are you going to follow up with this as it is very interesting?

I love this line of thought as it's very true. Either way you are offering money for sex, and either way if she agrees, she has consented.
