The landlord could not afford to fix the septic tank so the tenant decided to move out at the end of this month but didnt pay the rent for December. Is this legal and does the landlord have a chance of getting the December rent in small claims court?
This was on a lease purchase and in the state of Georgia

I believe you can sue. You can sue over anything.

But with rental issues like that you involve the city government. They will hold your rent till the landlord improves the porperty. YOU ALWAYS HAVE TO PAY!

Whether you are tenant or landlord in this situation - KEEP ALL RECORDS. Keep a conversation log, and record all repairs, etc. as well as the dates of requests, any thing discussed between landlord and tenant, etc.

Also, you may want to check your state's department of real estate website and search legal questions for leasing.

read over your lease and check for clauses.but you still have to pay the rent u can end up in court paying dec rent and court fee.

ya signed a lease ? ya ! your commited to your lease ! as far as the landlord hasn't made repairs ...take him to court to gain relief ! otherwise yes he or she will most likely win in court .

Now, you say this is a rental,
''BUT'' was on a ''Lease Purchase''?

Sounds like the tenant may be the loser if he/she moves
