i've been married for 22 years and recently found out my husband has been cheating for 3years, he says i cant touch his city pension or the house that we have been buying off his parents for the last 13 years, they have a promisary note saying they can live there forever but the deed is in mine and my husbands name.
I live in a no fault state (maine). Is he right and if i can get part of his pension how do they go about splitting it up.

Where I come from and where I live now you get HALF ( as Eddie Murphy ) would say. You should get half his pension for the 22 years you 2 were married and if the house deed has your name on it then...guess what ? Half the house is yours ( as in sell it, pay off the loan, split what's left down the middle. I would strongly suggest you get qualified legal council a.s.a.p. Lastly... there is nothing sadder than the death of a relationship, my most profound regrets to you and your soon to be ex. Hang in there.....it does get better.

First thing you are going to want to do is hire a family law lawyer. This way you have someone who has your best interest.

Since you have been married for so long your husband would most likely owe you alimony and that would include his pension regardless of what he says. Since the house is in both your names you are going to have to split it or one you is going to get the house. The laws vary state by state which is why you should hire a lawyer who knows the laws

I know that for sure government pensions belong to both husband AND wife. I would think it would be the same for a city employee.

by law, you will probably end up with half of his city pension. Don't let his words threaten you.....sorry, but your situation sounds like it's getting really ugly. Hope you can find a good lawyer.

Get a good lawyer, money no option you can figure out how to pay him later. put it on a joint credit card. don't be a fool the judge will use the Brown formula and believe me you WILL get your fair share. sounds like he's trying to scare you. stand up to him. get a laywer. seriously!

You can make him an offer to pay the house off and you keep the house...and let him keep his pension?_

In most states you can get a portion of his pension. BUT; this is a double edged sword, if you have a retirement plan, his lawyer can go after that as well..................
