I am not sure as to the answer. But as the others have asked, I must ask why you feel you want to marry someone in prison? Dont you think you deserve a real wedding, with all your family and friends there to witness it? If you truly love this person, and they you, then why not wait until they are out of prison. Then you can plan a real wedding, and go on a real honeymoon and actually spend your first week, month, year of marriage together.

Ms: If this guy to be husband has been arrested and in prison before this current incarceration, I would strongly advise you to reconsider marrying him. People in general make mistakes and sometimes, jail is the consequence ONCE. But if he has been in prison before DUMP him ! You don't want to be wed to a career criminal. Your children will suffer for lack of a father influence in their lives and YOU will not be too well nurtured either. Marriage is to bring out the best in two people not the worst ! you could get married in abstentia. . send him the papers, let him sign them in front of a notary . you get the papers back. . go before the local judge. .and find out how to file the papers..

maybe you might want to marry this man but please at least wait until he comes home and gets his life on track before you do. marry to a man locked up is no life.
