there possibly may be a way around a stautory rape conviction if your parents consented to the sexual relationship. I would look into parental consent as a defense to statutory rape.

In any event, I would seek out a criminal defense attorney ASAP and in the meantime DO NOT TALK TO THE COPS OR DETECTIVES. No matter what they say or promise they are only seeking information to convict your boyfriend. They are not your friends and they can not make things easier on you only harder.

Yeah, you guys really screwed up on this one. Not only is your boyfriend more than likely going to jail for 10 years, he's also going to be a convicted sex offender AND a felon. It's going to be VERY difficult to obtain a good job in the future. You're going to have a child without a father figure present, which studies have shown can be VERY bad on the social psychology of a young one growning up. But on top of that, your parents could be charged with child neglect/abuse by knowingly letting a minor in their custody have sexual relations with an adult.

http://www.ageofconsent.com/pennsylvania.htm

"Except as provided in section 3121 (relating to rape), a person commits a felony of the second degree when that person engages in sexual intercourse with a complainant under the age of 16 years and that person is four or more years older than the complainant and the complainant and the person are not married to each other."

"In the case of a felony of the second degree, for a term which shall be fixed by the court at not more than ten years."

So, sex w/ the b/f might put him in jail for 10 years.

Personally, I'm expecting your parents to be brought on charges of child abuse / neglect for letting the two of you date. Your parents should NEVER have let you see each other.

Orzoff is completely incorrect in stating that there may be a way around it if your parents consented to the sexual relationship. Why? Because it’s illegal, and parents cannot give their child and/or their child’s boyfriend/girlfriend permission to break the law.

As others have stated, your parents can in fact find themselves facing neglect/abuse charges IF they knew it was occurring and gave it their stamp of approval/failed to take steps to put an end to it.

All it’s going to take is a DNA test to prove Boyfriend’s guilt.
