Alright, i am a 15 year old girl, and my boyfriend is 21 (he just turned 21) but i am pregnant, and the cops found out about me and him and the age difference, and he might go to jail for Statutory rape, we haven't gotten any news yet, but my parents were fine with me and him once they found out we were expecting a baby, i just need some info on the statutory rape law in PA, and like how long he could go to jail for n all that, just things like that.. please please!!

“a person who has been convicted of a felony may be sentenced to imprisonment as follows: In the case of a felony of the second degree, for a term which shall be fixed by the court at not more than ten years.”

It doesn’t matter if your parents aren’t pressing the issue or not, because it’s not your parents that press charges, it’s the state. And it doesn’t matter if you consented or not, because according to the law it’s illegal for him to have sex with you—period.

Subchapter B. Definition Of Offenses
§ 3122.1. Statutory sexual assault.
Except as provided in section 3121 (relating to rape), a person commits a felony of the second degree when that person engages in sexual intercourse with a complainant under the age of 16 years and that person is four or more years older than the complainant and the complainant and the person are not married to each other.


Felony means a minimum of one year in prison.

Well the age differences only matter because you are a minor! But you know now that you are bringing a child in the picture it changes things! In most states he would definately go to jail! What disappoints me is when a 20 year old goes to jail for being with a 17 year old! Thats ******* stupid! Only 3 years difference but its the law! People need to recognize the differences between childhood sweethearts and pedophilia! I know if you where my daughter, I would be PISSED! But hey if your parents are okay with it, I guess I have nothing to say!

He'll probably get a minor slap on the wrist if your parents are not pressing the issue. I was raped by five guys when I was 13 and lived in Pennsylvania, and all they got was fines (none of which came to me to pay my doctor bills) and probation. The DA could not "prove" that I had not consented. My word was not good enough, of course, and since my sister was known to be rather easy, they assumed I had volunteered to take on five guys at the age of 13.
