Depends on the laws in your state. Go to the local Court House. The clerks there are (usually) very knowledgable about the local law, and specific steps you have to take, depending on your locale.

These days, cover your butt with formal notices In Writing, no matter what you, so you don't wind up losing everything

Since she is not the named tenant on the lease, you should have no problems evicting her. Best thing to do in this situation is to contact a lawyer and have him walk you through the proper procedure. Property law is a mess in someways because many of the ideas underlying it date back to the middle ages. You don't want to get caught in any loopholes or other seeming insanity.

If you are going to be a landlord, I would recommend definitely getting up to date on all of the tenant laws in your area. It will give you a better idea of what you can and cannot do as a landlord.

In California you have to evict her, lease or no lease. Sucks, but the owners really don't have many rights.

Call the sheriff and have him escort her off the property. If her name is not on the lease, she has no right to be there.
