My mom and dad were divorced several years before, and unfortunately, my sisters were given to my dad. But just a year later, my dad became estranged from the family, and my mom took all responsibilities of my sisters, who have lived with her for the last 2 years. She doesn't have the money for a lawyer and desperately wants to have official custody of my sisters.

Just contact the court office for the forms to petition the court for a remodification to child custody hearing. A court date will be assigned and allparties involved will be notified of such. Your mom can ask the court to let the girls decide who they want to live with if your dad shows up and starts trouble otherwise all she has to do is explain the situation above. You dont need a lawyer to do this but may have to pay a filing fee.Good luck

She's gonna have to go back to court and have custody officially changed. She will, at a minimum, have to pay to 1) have the case re-opened; and 2) have him served with a Petition to modify custosy. Unless she knows she about legal stuff, she needs a lawyer b/c she needs to get child support and other stuff she may not know about.

In the end, I assure you it will be worth the immediate expense

And FYI--unlike as stated above--most County Clerk's offices can't help b/c they can't give 'legal' advice.

She should be able to get a lawyer pro-bono. which means she gets free legal help. Or for very little money. And if she can talk to your dad. Ask him if he would agree to have the papers changed. Besides if she can prove that she has been taken care of your sisters and all she has to do is check out a lawfirm in her area and ask about probono. They should be able to give her the answers she needs . I wish her luck. And you as well :)

Have her go into the Family Law Court in your county. She will find all the help she needs in the Clerk's Office. They have people there who can help your mom fill out the right forms and fee waivers if she qualifies based on her income and debt she may have.

to make it legal and in her name she needs a lawyer.
Your dad can not have any rights except visitation if the court allows it.
If it is not legal , your Dad can fight for custody.
There is legal aid.
Your Mom needs to find all the possibilities that will keep you all together,

I'm not a lawyer but I have always heard that children 14 and over get to decide who they live with unless abuse is involved.
