I was thinking of moving away to another state I live in Pa, and want to move to Mi,
I want to take my children with me because I don’t feel they are in a safe imvorment.
Me and my wife are still married but separated neither one has custody of the children, I feel they are much safe with me. My wife has a new partner now that has been incarcerated for a FD Battery. Since there isn’t any custody order and we are not Divorce
Can I make this move, with out any problems with the law being involved?

Custody issues vary from state to state. I would seriously talk to a lawyer before you do that. At least just a consultation. There's no point in moving, pissing off the wife, and having her stupidly win custody because you (for their safety) moved. Laws are stupid, but you can get screwed if you don't look into them. For your kids' sake, please research this very well before you do anything!

no- do not move with the kids without telling the wife. You're jsut gonna have to talk to her and see what she thinks. I'm sure she will not be ok with it so- you will have to file for divorce and prove to the judge that you wife isn't in a safe enviroment so she can't have custody of your kids. IF you just leave-s he can call the cops on you and you will be wanted for kidnapping. At least try to talk to her first and then go to court. It will take a while but- it will all be ok.

Try to work it out with your wife first and express your concerns about this ex-convict being in contact with your children. That should really be enough. If not and she gives you a hard time, go see a lawyer or legal aid and get some advice, since you're not divorced. It sounds like you have grounds to have your children with you because of the unsavory elimate (ex-con) your wife has brought into both her life and your childrens' lives. Don't waste alot of time your childrens' safety and well being are at hand. Act immediately.

I'm not totally sure about P.A's laws but for the safe thing to do you should get a tempory custody order through the courts before you go to Mi. so nobody freaks out and says you kidnapped the children.Good Luck

you know its funny how some people answered your question. They are your children to . You have to remember everyday everywhere woman leave with there children . Its just a normal thing for the woman to take the children . What is yours is hers and what is hers is yours . You made them to . If you and your wife communicate well then talk about it if your not sure. Never second guess your children's safety. Your and good dad if you are worried about that in the first place.

When it comes to custody issues, there could always be problems. Unfortunately for you, the courts often favor the mother over the father. I would let it lie for a while. And get the divorce immediately! Let the judge hear of your concerns, then he should award custody to who he sees fit.

You cant just move and take the kids with you unless you go to court and do it that way. If you just take them she will have the police on ya *** and you will never get custody of them You need to get a lawyer and do it the right way.

Hi,I respect your conserns on this. What I feel you should do is contact a lawyer or leagle aid. As a last resort ck with the State Police. I'm a single Dad too and want to go on with life...but I too want the best for my Son. I hope I've been able to help you. Good luck.

you can not take ur children out of state without ur wifes consent...if u do this would be kidnapping and a felony...if u feel they are in danger stay and get a damn good lawyer fight ur wife for custody of the kids and then see if u can move them out of state...i wish u alot of luck

i really think you need to talk her into giving you custody of the kids. of course the courts will have to be involved. that will make it all legal.
