How is the situation handled if they refuse to leave?

[Does an individual have rights if the he/she was never a tennant and received a written notice several months in advance?]

State law can vary, but if they have not established a de facto residency, then you can pack their belongings while they are out of the property, and change your locks. Leave the bags somewhere safe but outside - in the garage maybe.

If they then try to force their way in, they are committing breaking and entering, or burglary, and can be arrested.

It all depends on your state. If you tell us where you live, we might be able to help you. Or you can look it up yourself. Generally, if the person is not on the lease or deed, you can have the police remove the person at any time.

Change the locks. Send the person written, certified US mail, notice that they are not welcome in your home. If the person comes around don't answer the door and call the police.

Call the police who will likely tell you to contact a lawyer.
