That's not what it says. If you settle the case BEFORE a Complaint is filed the rate is 33 1/3rd of the settlement amount. If you settle the case or win at trial AFTER a complaint is filed, the percentage is then 40. You would not pay 73%, only 33/13 or 40% depending on which way the case goes.
Yes, those are both common rates.

It's a pretty standard atty fee contract, however, you should be able to find some attys that will take 33% regardless of when the case settles + costs of course.

You won't be paying 73%, you will pay either 33 1/3 OR 40%, depending on when the settlement is made. One third is normal, or you could call and see what Legal Aid would charge.

It does not sound right.
i think the "AND" just before the 40% should be an "OR" generallly attorneys get 33% on average for recovering money or something of this nature.
Bring your question to him and don't sign anything until you are happy with the way things are written.
Do not take his word for it that he will fix it after you sign the papers. Only sign them when they are correct.
If he is unwilling to do this. Get another attorney.

You might want to see if the "and" shouldn't read "or" in there, just for clarity's sake, but that's the meaning I get from my reading. It'll be a little more verbose that way, requiring further clauses to be certain of the meaning, but what legal document isn't verbose?
