This would allow him to stay on past 2008 and declare Martial law until the terrorist war is over ( never?) It has worked for others before, like Marcos and Castro.

Or maybe like the supposed attack on our ship in the gulf of Tonkin that was used by LBJ as excuse to get into the VietNam war

No. He is already extremely unpopular, i can't imagine how many people will hate him in 2008. To pull a stunt like that would be very dangerous.
