I entered this program 2 get a divorce 4 free b/c I don't have money & waited almost 8 months 2 get on the list.Then it took me like 2 more months 2 fill out paper work b/c my lawyer went on vacation & when she got back, she was sick w/Pnymonia(sp).I understood that she needed time off as we all do.I find out that my papers were filed N court & then he got served like 2 weeks ago but then my lawyer called me & said that he has a lawyer 2 as of last Tues.I also got served some papers from him that same day & come 2 find out, he filed his papers 4 days b4 mine. His mom has money 2 get his lawyer, & I had 2 go through all this & all that work doesn't mean anything.Now he wants 2 make all the rules & make me pay 4 it.I don't want anything from him, I want 2 keep my car & he can keep 2 cars, but he wants joint custody but hasn't paid any child support.I want sole custody w/supervised visitation.My first child isn't with him but he doesnt know that i'm getting child support from the real dad

The reason why I didn't tell him is b/c he was very controlling and abusive to me, mentaly, physically, financially, etc...As a mother, I knew what type of man I married and I had to do what I had to do...He's not dependable and I gave him chances to redeem himself but didn't...I'm not saying he's not a good father but he hasn't been there financially...He's made my life sad but I have strength to move on and I did...I've been doing ok. His mom always been there for the kids sake but when she saw me with my new guy, she got mad...it's been almost 2 years we've been away...she cut my cell phone off and got him a lawyer and want me to pay for the court costs and etc...I think it's not fair to me...

it's too late to get a new lawyer b/c he already filed 4 days b4 mine was filed plus she's doing it for free...

As far as custody and support are concerned, they are two separate issues. The child support does not depend upon parenting time and vice versa. So, theoretically speaking it doesn't matter how behind he is on child support, he could still get joint custody.
As far as supervised visitation goes, unless he is abusive in some manner, the judge will not go with that. More than likely it will be the custody arrangement that is in force today with him getting visitation, unless you can prove somehow he is unfit. Any sort of PROs you have will help, as well as police complaints.
And as far as him not knowing that you get child support, he will very likely know soon enough, and unless you are ready to commit perjury (and your lawyer should be telling you what the penalty on THAT is), that other lawyer will be filing discovery motions on all your income from all sources.
But in the end, it's a real cut and paste job. They'll look at parenting time, incomes, done deal on that end, good luck on your new lives.

The lawyers and the Judge will sort out all the finances and the child support. Don't worry, unless you are a crack addict you will be OK. Most times nobody comes out of these things completely happy.
