I've been on maternity leave and have finally decided for sure not to go back to the job I love. I'd love not having to take my baby to child care more, though. Someone said that I will owe if I take my whole leave and then resign and I don't intend on paying my employer, so here is the question:

My 12 week Medical Family Leave began on October 10. I will inform my boss and employer of my plans to not return on

Wednesday, December 6. My day due back was going to be

January 2 -- that's 12 weeks.

I used up my vacation and sick time about 10 days ago so now my leave is unpaid. Help me figure out this math as according to what someone here on answers stated, I will owe them for I think 2 weeks at this point. Sorry if I have confused you along with myself. THANKS!!

Under the Family medical Leave Act, the time off is unpaid, and as you stated you have used your vacation for part of it. If you resigned, you will owe your employer nothing. In fact, you may have some compensation forthcoming.

What about medical insurance? If you want to continue it with the employer, you can subscribe to the Company's plan under the provisions of COBRA (Consolidated Omnibus Budget Reconciliation Act which modified a number of federal laws to permit continued medical care coverage ) if you worked fro an employer with 20 or more employees. The full cost, plus a 2% administrative fee will be your responsibility. Contact the Human Resource office to find out if the company is subject to COBRA, and what the monthly payment will be. Sometimes it is cheaper going outside the company and getting medical insurance from an insurance carrier like Allstate, or State Farm, or Prudential, or the company that your employer uses.
