I would say no, unless the artist posts a legal blurb on their music page stating that the music they have available for download is free and giving you consent to download it. The problem is most artists haven't done this and enough legal battles haven't been completed to enable a universal set of rules in cases like this.
The problem I have seen is that anyone can open a Myspace music page. In turn fans open pages about their musicians instead of pages by the actual musicians. Then those fans distribute & stream their music. While all of this probably promotes the artist in question, it's most likely illegal. Occassionally I've seen fan sites close down and then transfer the userbase to the real artist who makes a myspace music page.
If there's any question I would email the artist and ask if they are the actual artist or a fan providing the music. If the song is designated as stream only and not for download, using software to capture the streaming content would be illegal since the artist didn't specifically designate it for download. In many cases the actual artist (especially for non signed independants) will answer your email, and often will offer free cd's to help promote their music.

all answers so far are half right, unless it is music by an unsigned band and they are telling you the music can freely be downloaded.
any doubts contact the my space user and ask them if they own the copyright if not do they know who does, and where you can get a legal copy. unless you want to risk being fined.
Myspace customer service should be able to help you.
also the music you hear on the site should not be on the site if the myspace user did not create it or does not own or has not paid for the publishing/ broadcasting/ public use rights from the copyright holder.

There is small print written by MySpace that it is technically the user breaking copyright if they download music, the site accepts no responsibility.
However MySpace is currently being sued by Universal Music Group for blatantly endorsing copyright violation:
