Ok, my husband, his ex-wife, her current husband and myself would like to amend his child support. He's paying a large amount, that was based primarily on child care that is no longer needed and a job that he made a lot more money at. Here's where it gets tricky - the ex-wife and new husband agree the amount should be reduced, but she is no longer working, so if they look at incomes, his amount will just be more. She (the ex) also wants my husband's back child support waived. How can we do this, preferably without spending a billion dollars on a lawyer? Can we file a motion on our own and just pay court costs? Can we file something stating what we want without going through the formulas?

He can definitely do it without an attorney involved. He needs to file the paperwork with the courts. All it would cost is the filing fees. The paperwork can be located at the courthouse. Just remember, he can't stop paying childcare officially until it has been stopped by a court order. I have included some links that could help him more with the process. Good luck!

You have to file for a Modification. You will have to have an attorney(basing this off of my personal experience in MO). They will not do away with the back child support he will have to be responsible for paying that......if she is willing to amend payments then the process should be simple, therefore, it will not matter if she is unemployed b/c she is willing to amend the payments. I am not sure of where in MO you are located but I am in Kansas City, and I have a great attorney whom can get a free consultation from to determine what is right for you and your husband to do. she needs to call child support enforcement and although the back child support will not be dropped regaurdless she may be able to get the amount he pays each month reduced. Even when a father gives up custody of his child to be adopted to a new husband he still owes what he is behind.. Good luck i can not remember the name of the paper you need to ask for to have them lower the child support but just call your local cse office
