john marvin smith and joe smith are brothers
joe smith has a son first names his son john marvin after his brother as a sign of love and respect...
john marvin the elder has a son after his brother does and names him after himself as it is his first son so now we have john marvin smith sr and john marvin smith jr
what order is the name of the nephew - is he a second, a third or do he and his uncle share the same name just a two complete strangers would?

My understanding is that if your father does not have your same full name then there is no order necessary.

While the cousins have the same name and that could be confusing, the names are not ordered. The only order is grandfather, father, son, etc.

He's not in the same immediate family as the other John Marvin Smiths, so he's known as John Marvin Smith. No II or III, if anything, he'd be a I.
