my husband has 2 cats that he's had for 10 yrs.....i say that they are HIS pets(and thus should take care of them).....he says that we're married and they are OUR cats (and that i'm also required to care for them).......i'm wondering what would happen if we divorced??? cuz if they are OURS then i'd be entitled to half right?? (we live in a community property state by the way)

by the way i'd never think of fighting for custody of his cats, and we aren't getting divorced.......i'm just curious

There are arguements to get the cats if you wanted them however if it's just peacable and he's keeping his cats then there's no issue. Legally when you get married everything becomes collective property but that doesn't mean you have to take care of his cats it's whatever you two agree on.

Oh, and I forgot to mention, with the community property, it's only things acquired during the marriage that become collective property, except for gifts and inheritances. If he got them before the marriage, they're just his cats.

There are many court cases where couples have gone to court over pets......Its stupid....but hey...if a couple is really getting divorced most of the time they were because one was just trying to make the other miserable.....but pets are just like anything....you could go to court over them....some people are just will to go to extremes to get back at a ex-spouse....

And don't feel bad...my wife tells me all the time that the dogs are mine not hers....especially when they get into trouble......of course they are hunting dogs and are with me about every weekend in the field...

Animals are not like children. Effectively, they are property. He cannot sue you for "cat support."

If you were to divorce, I presume he would take the cats and would thus be responsible for their upkeep.

Interesting question.

if you get the cat, you can give him away to someone anyway. unless you want it. your husband can visit anytime,
