and if you draw money off the acct, and the check comes back, nsf who is responsible for paying the nsf..the person who issued the check or the person who cashed the check?

Issuer of the check. Take them to court. That large an amouunt is a felony anywhere.

I would say the person who wrote the check is responsible for paying the NSF fee because the check is supposed to be drawn from their account.

Since this is such a large amount the person should have been more mindful to verify how much funds were available before writing the check.

I would contact your bank to inquire.

You would be responsible for any charges from using the money but the person who issued the check is responsible for making good on the check. Talk to them!! and then ,if needed, talk to the authorities.

ogrendle is absolutely right, it's a felony. UNLESS the checkwriter is your spouse! I got a check for $45,000 from my husband's company checkbook that HE deposited without me knowing, and YES, it bounced all of my checks on my individual account and I had to repay the checks AND the bank fees.

There needs to be a law that NO ONE can deposit into your account accept YOU.!!!!!!!!!!!

The business is liable if it's check bounced.
As between you and your bank you are responsible to your bank and you must pusue the business to force it to make good on the check.

According to the bank, you, as the account holder would be responsible for the charges related to your account. Good luck with your situation.

the one who issued the check but you will have to collect from them - you are responsible for your own accounts
