Ethically speaking I would say they cannot terminate you if you are on sick leave.

Your job is protected by the federal Family Medical Leave Act.

However, you should know your rights and the terms of your leave should have been discussed with you by an HR Rep before you went out on leave.

If this has occurred you should seek legal advice from an attorney or contact the Department of Labor in your state for advice.

Usually not done unless you continue off after your sick leave bank of days is expired. Lots of variables here tho . . .

Legally, no - but they do anyways.

Hire yourself an attorney if this happens to you. That's all you can do.
