If it was not due to you then yes they could claim it back,in law it could be classed as stealing ,obtain some advice about this as you do not want to be in trouble over this,even though someone has made a mistake and it is not your fault,you sure its not holiday pay owed to you.?

It could be your vacation pay or money that has been due to you. Find out. Call them. Ask why they had sent you that check. If it keeps comming in, it's their accounting error and you are not liable for it. You had made an effort by speaking with (get the name of the accountant) and finding out if this is an error. Otherwise, you have considered it a gift!

Ethically speaking if the money is not yours and you do not work for the company any longer you should give it back.
If they want to back track and trace where the money has gone they can legally claim it back. It is up to them regarding the time limit.
If I were you I would not keep it......

My daughter was over paid on her last pay check before leaving her last company. 6 month later they realised and asked for it back. She ignored them thinking they would go away as it was their mistake. They eventually passed it to a debt recovery agency without telling her and that cost her extra to pay it back.
So keep the money safe and pay it back when asked.

They can claim it back. They can even reverse the bank deposit if they decide to do so. However, it's their responsibility to keep track of your pay. Just don't spend it. The chances are they will probably notice. If they ask you to pay back, just pay back. If they don't notice when your next W-2 arrives, they will never do.

I don't know about a time limit but you should be honest and tell them about it. If you spend it they will only eventually catch up with you once they have realised they have paid you and you will have to pay it back is it really worht it?
