Even if a penalty could be given, it would never happen, on any level. Too many people would oppose even the idea.

Why do so many people think that he has done nothing wrong??? Why do we still think that he simply erred but was attempting to make a calculated decision that best served the United State nation?? Perhaps he did if the United States you have in mind are those that have investments in defense contracting and big oil companies ... Such as Rumsfield, Cheney, all bush's, Rice ... on the other hand I don't think any of the above mentioned really thought that going to war would make us safer. Will this matter really get proved in a court of law?? Well we need to get beyond the ignorance that some revel in. I want everyone to love there country. Love isn't complacent. When something is painful it is love and care that calls attention to this pain. Love wont shriek from the unpleasant. If you love America then educate yourself to what you don't enjoy knowing. Know the real truth. From the real we can move forward.

For the people who think Bush and Rumsfield and Cheney are not war criminals, SHAME ON YOU! You choose to remain blinded and uneducated.

Things you should know that the Bush Admin should held accountable for:

1) The mistreatment in the Guantanamo Bay prisons.
2) The mistreatment in Iraq's prisons - (approved by Rumsfield's signature).
3) The numerous secret torture prisons that became public.
4) The fact that the Bush Administration sought legislation to excuse themselves for all war crimes against the constitution and the Geneva Convention since 9/11. (Congress was stupid enough to pass this legislation).
5) The passing of the Military Commissions Act to strip unalienable human rights of "terrorist" suspects (domestic and foreign) and hold them without reason or chance to refute any charges against them.
6) The fact that the Administration lied to go to war which cost billions and billions to the public and cost the lives of hundreds of thousands of people, leaving hundreds of thousands of refugees homeless, and increasing violence in Iraq and bringing them into Civil War (a plan orchestrated since the 80's by the Pentagon).
7) The NSA wiretapping scandal (domestic spying) - which was ruled to be unconstitutional by a federal judge.

WE THE PEOPLE SHOULD BE FREAKING PISSED ALREADY! IF YOUR ANCESTORS WERE ALIVE TODAY, THEY WOULD HANG THE PRESIDENT.
If you think these things are ethical to the human race, you ought to be shot out of a cannon into the sun because you are a threat to our species.

Personally I would like to see the same standard of proof applied to the people making the 'war crimes' accusations. I expect that they would start screaming about 'innocent until proven guilty' and 'due process of law' if we started accusing them of supporting terrorists.

If you are willing to indict somebody on the basis of rumor and innuendo - should you not be willing for yourself to be indicted on that same basis?

We'll have to see how the trial turns out. Germany is considering putting Rumsfeld on trial for war crimes for his actions in Iraq, and for the secret torture prisons. I don't know if the US will agree to extradite him to face trial though.

same thing that was appropriate for Lyndon Johnson for getting us in a war in Vietnam where we had no business being. Nothing.

the same Roosevelt should get for getting us in the European arena of WW2.............nothing

Face it, presidents make decisions. Just because a group doesn't like it, doesn't give them the right to whine and file suit.

Bush and Rumsfeld should be charged right after a whole book of charges are filed against Clinton....starting with his cozy dealings with China that got this country in the shape it's in today.

Put them in the same tank with Saddam. Let them talk about the wonder years and how it all went wrong. After all the constitution is just "a frigging piece of paper"...

well, first, they are war criminals.though you,and a lot of other people,do agree or approve of their actions, they've done nothing to designate them such a title.
perhaps there should be a penalty for slandering a person as such....
i'm not suggesting you not have your opinion, but to call a person a war criminal would require that they've done something to earn such a title, they have not.....
