You are the only one who can answer those questions. Sounds like maybe he should have custody. Honesty is the best policy, he has to prove what he says, is that what is making you nervous?

the law is always sided with the mother in this case. which is unfair in some cases. but in your, just point out that, the allegations are false, u miss ur kids, u live foor them and u r not wanting to deny them of access to their father but shared. its all about the child, thats what the judge goes on. the best interest of the child always. i am a social worker, i know these things. I guess u have had a tough time. point out that ur life has changed an u want the most normal upbringing for your children. if he does get access, keep taking him to court, keep pushing always. if u were not married to ur ex and he is not on the birth certificate, he has no right to the children. u r most likely to win, but show no ill feeling towards your ex. even if u feel it.

It's not YOU that should be presenting anything in court----IT"S your Atty----He should be presenting the FACTS----NOT YOU---if you're trying to do this on your own PRO SE you'll be screwed for sure! Judges do not let their court rooms become a he/said she/said screaming match! (that's TV)
Your atty should present whatever evidences you have as far as proof....DCFS reports and allegations, Witnesses on your behalf--a smart judge will be able to tell if the children have be coaxed or coerced in their responses---
It is terrible how 2 adults can't communicate better and resort to using the children to establish control. Who ordered no visitation? Did DCFS's involvement have something to do with the removal of the children and no visitation?
You really have left your question open ended with out more information regarding your situation.!

HI - are you lawyer-less?
In court, stick to the facts. Do NOT let the emotional part of your relationship with your EX to cloud the proceedings. Express to the panel or judge your feelings and positive actions for your CHILDREN.
