Is this covered under homeowner's insurance??

I live in the midwest where we got pummeled by an ice storm.

you are responsible for damage caused by acts of god, such as an ice storm.....
if the tree was diseased and it had been leaning over for a long time, it would be up to the owner of the tree to pay

Your neighbors insurance company, if he has insurance. I live in So. Cal., so your insurance companies may have some kind of clause that protects them from damage caused by a storm, but I doubt it. If nothing else, the guy should fix anything that got damaged on his own efforts. If the only damage is that you have a tree in your pool, ask if he'll remove it when the weather permits. If he says no, there is always court.

I live in kentucky and in 2002 we had a horrible ice storm and from experience I hate to tell you but you are responsible. Our neighbors tree fell on our roof..Our homeowners had to pay. Sorry.

Your neighbor's homeowner insurance should pay, but if they are giving you a hard time then file under your own insurance and your insurance will get a reimbursement from the neighbor's insurance.
