she is staying with me, and has 0 transportation to go pick up her children, and I am really tired of driving her everywhere! I have my own family to worry about, and her husband and her only had one car, and he refuses to let her have it. She also needs to get to work, and with me having a 4 month old I dont want to go out in the snow everytime she has to go to work, get something to eat, see her kids, etc.

No. She needs to wait until all of the finances have been accounted for. Until she gets a final decree of divorce both her and her future ex are still tied finanically and depending on what state she lives in a new car at this time could be considered a marital asset.

No, if she buys the car before the divorce is final the husband can try and take that car.
I would tell her to buy a junker for now, just until the divorce is final. Something to get her around.

A good lawyer is worth every penny. Tell her to hire one. I wouldn't buy a car right now if I were her.

from what I understand, once you're separated & living apart, papers filed, anything you get is yours, & it's the stuff acquired in the marrige that has to be split...
