We were getting up to 7 calls a day from some 866 number. They never left a message and always hung up after 3 rings. I was ready to call the phone company and report it as a harrassing call. Tonight, Sunday, approx. 6PM, the phone rang and i answered it. I was put on hold, then disconnected. I called the number and it turned out to be RPM, a collection agency. I had "words" with the woman who answered, who was VERY nasty with me right from the start. All over a balance of $38.00??? Is this legal?

NO it is not legal. Tell them you are going to sew them for harassment if they don't stop calling.

They can call you at home, but not at work. If you pay up (it's only $38 as you mentioned) then the whole problem goes away.

The frequent calls are most likely something called a predictive dialer. This is a computer system that automatically calls people on their list until someone answers. It should then transfer the call to an agent, but if there are no agents available, it just hangs up. They are extremely annoying, and not just used by debt collectors. These machines are however legal.

They can call you from 8 am to 9 pm. What you can do is send them a certified letter directing them to stop calling you both at your home and any other number. Explain that you are disputing charges and all correspondance with you must be made in writting. If they continue to call you after that you can seek legal recourses. The letter must be certified to prove that they recieved it.

They can call you until you tell them not to call. If the person on the other side gets nasty you need to ask for their supervisor and get their name and name of their company for your records.

Do you owe them $38, and have you paid it? If yes you do, and no you didn't, they have a right to contact you after 8 AM until 9 PM, with no limit on the number of times they can call. If you want it to stop, pay the bill.
