True. Everything has momentum. Even the rate of heat energy transfer has momentum. So, the water with more heat energy [i.e. temperature] will begin getting rid of the heat energy into the less energetic environment--the freezer--and it will do so more quickly than the less energetic [or "cooler"]water. It's momentum will cause it to equalize with the ambient energy of the freezer sooner than the "cooler" water will.

The cold one will freeze first - it has less heat to dissipate.

However, if the first one was heated (perhaps to boiling) it will freeze more CLEARLY, because much of the air has been disposed of already. It will take longer to freeze than straight cold water, but it will be a better looking chunk of ice.

The warm one will *not* freeze first. False.
This is one of those 'urban legend' type stories.
