I have someone saying I owe them money and is holding my personal items till I pay can she legally do this

She cannot hold your belongings legally. She is not allowed to resort to "self help" in that way. She needs to sue you in small claims to get her money.

Oh, and you could sue her for your things but you will need some proof that she has them and of the value of the things.

it depends on the value of the items, where you live, and the amount of money you owe. If the items she is holding are worth less or equal amounts to what you owe, if you do owe them money, it's probably legal. If you don't, then no, it's called extortion and it is against the law. Talk to a lawyer in your area if you do not actually owe money.

depends. I need to know a little more facts.
How did this person get your items? did you sign an agreement? Did you tell her you would pay her? Why do you owe her?

if you AND her signed a paper, yes.
if you told her you would pay her, yes. (its called a meeting of the minds and both parties agreed and understood EXACTLY what was going on)

No, they legally cannot do this.

You can choose to ask a police officer to go with you to the place where they are being held and ask for your things, or you can take them to small claims court if there is anything under a few thousand dollars.

Is it a landlord? Did you sign a lease saying she could do this?

Absent your agreement to this, you can either file a small claims suit, where you both prove your cases, or you can call the police, since this is like a theft.

go to your local police dept and report the items stolen by this person...if that does not help file a claim in small claims Im assuming that its under 5k.
