"Christmas is the one of National Holiday" is violation of the Constitution of USA.
Is that correct?

No, the government can create national holidays - but they can't make one religion the official religion of the state. (First Amendment to the Constitution).

If they wanted to, they could create a hanukkah holiday, as long as they don't pass a law making Judaism is our official religion...

The Constitution does not prohibit the practice of religion even by government. The separation of church and state is a specific prohibition on government creating a state religion. The Founding Fathers were in fear of entity like the Church of England, but they were still religious men and did not intend for religion to be completely removed from government. Instead they wanted all men to keep their own religion equally. This one area of the Constitution has been so subverted that for many the original meanings are no longer discernible. The answer to your question is no. Christmas being a National Holiday is not a violation of the Constitution because no one is forced to observe it and businesses are not ordered to close on that day.

No, it's not a violation of the constitution at all, we have the right to celebrate any holiday we choose, no one prevents any religion, or belief from celebrating their god or higher power. The only reason Christmas is so popular is for the fact that the majority or this country has been Christians and hopefully will always be.

No it is not. The legislature has the power to enact such laws and if they do so, generally speaking, it is within their power granted by the Constitution. However, Christmas is NOT legally a holiday at all. There is only ONE legal holiday and that is New Year's Day. Individual States have the power to enact holidays as such under their own state constitutions.

I am not religious at all, but I think that Christmas should be a national holiday because it is a tradition. It was a pagan holiday even before Christ was born, and we can't just decide that it isn't a holiday because some people are not Christian. Nobody is forcing religion upon people, we just want to celebrate a tradition.

Which ammendment of the Constitution of the United States is Christmas violating?

What saddens me, is that this country was founded on the principles of religion and freedoms that our forefathers established centuries ago. Why is it suddenly politically incorrect to celebrate a holiday that has been celebrated in most countries who celebrate Christ since the beginning of Christianity?

Why is it that those who have immigrated to our country feel insulted by the fact that we celebrate the birth of Christ?? Weren't we here first?? Why can't American's celebrate as they wish to celebrate, and those who immigrated to this country, be allowed to celebrate their own beliefs, as they see fit, without infringing on the rights of others? I don't see why American's should have to set their own beliefs aside for the sake of all those who have immigrated to the United States. It doesn't make sense. None of it makes sense. The country has already separated Church and State, what's next? Next thing we know, foriegn immigrants who settle in the United States, because our Country is so damned great to them, will be *running* our country as they all see fit, without regard to our solid foundations which this country was developed upon.

Everyone is so concerned about insulting the U.S. immigrants with all the Christmas hype, and yet- no one seems to be concerned with the insulted AMERICANS who believe in Christ, and believe in the Spirit of the Season, and should be free to express those beliefs as THEY see fit. We live in a double-standard society, it's very sad. I feel sorry for our children of the future, and only see chaos and unruly societies, because people who immigrate to this country can't agree to abide by the established constitutions of the United States.

NO! For one, the seperation of church and state was intended to keep the church from running the affairs of state and to keep the state from running the affairs of church. It was never intended to make the governement all powerful and deny christians the first ammendment right of free speech. It was never intended to keep pushing one religion into the dark. The basis most people believe all this crap from is Ms. O'Hare and her court victory, and people just keep applying it to other matters.

Celebrations of holidays are ok in my book and praying before session etc.

no, there is nothing in the constitution that would prohibit having national religioius holidays.

There is no seperation of church and state ( read the actual consitution one day)
