I came out of the grocery store to find a shopping cart on my car.It left a HUGE dent.The car is new,so I parked far away from every one else so I wouldn't get door-dings from careless slobs.Unfortunately all that extra room provided the cart with plenty of asphalt (it's a sloped parking lot) to gain a good deal of speed.
The problem I'm having with convincing the store to pay up is that I waited until the next day to report the incident.But I had what I feel is a good reason to wait.I wanted to go home and get my camera so I could get pictures of the parking lot,but the batteries in the camera were dead and needed to charge.The lot was FULL of abandoned shopping carts that day,and I wanted photographic evidence that the store wasn't taking reasonable measures to keep the lot orderly.But I wanted to get the pics BEFORE I made a complaint,otherwise they would've had the lot cleaned up.When I went back the next day the lot was full of carts again,so I was able to get lots of pics.

I appreciate the answers so far.Thank you all very much.
But putting up a "not responsible for shopping cart damage" sign doesn't absolve the store from responsiblity.That is merely a psychological tool to deter the uninformed from pursuing legal action.

yes- it was a meijer store in southern mid -michigan. This happened approx. in 1987. they did honor the estimate and paid for the damage. whether they had to or not im not sure-they knew that i was a good customer of theirs and they were very helpful in this matter.

Most shopping centers and grocery store parking lots have signs posted, releasing them of liability due to shopping cart damages. It's very hard to go after a grocery store to pay for damages.

I haven't lately, but then again, that's not a good thing.... The store just down the street--yes, it's a new place, but still--has pretty much got to the point that 80% of the people there don't even bother with the shopping carts anymore. It's the "anti-theft" system, which means at any given time any cart can lock up and have a bum wheel. Really, it's gone completely random now. I blame the store somewhat: they did this in their paranoia, worried that folks in my building would steal their cheapass, tiny little carts. Please. They're too small. Most of the people in my building who would run off with carts run off with *Bigger ones*. But yeah. o_o This sort of crap happens when you're stuck in public housing...people think you're evil or something.

Well. stupid me.. I just never went any further than the sign that said not responible for damage. I know I've had damage from people backing into my car and just leaving and I was told that's what you have insurance for, that includes the "no fault" thing. Unfortunatly it doesn't stop your insurance from going up when you file a claim. I had someone back into my new mini SUV. There was even chunks of wood left in it so I know it was someone probably with 2x4's or something hanging off their tailgate that just mis-calculated the distance. I figured it was "evidence" and well.....the officer had a good giggle and told me I watched too much TV. When I found the cost of repairs.....well I just left the dent coz it's not worth the increase of insurance and I drive a car to it's death instead of trading all the time.

In some cases like the above answer you will find a good guy and they will pay the damage, however in most cases they fall back to the little signs all over the parking lot that say "Not responsible for damage caused to vehicles, parking is at your own risk" and they will send thier over paid lawyers to court to fight the issue.

First no a camera photo is not an excuse, you just did not report it when it happened, and there is no excuse for that.
** go into store and buy batteries, go into store and buy a disposable camera, get the name of other people who would testify,

Second,even if you did, ( at least in the US) stores are not responsible for cart damage, so they would not have paid, even if you reported right after it happened.

You might get a judgement with the right jury; but in fact the store doesn't have liability. The person who rammed it into the side of your car, or who left it in a place where it might cause an accident, is liable.

I know at Wal-Mart magmnt alway looks over video tape from the day it happened to see if it is on tape, if they can't find it on the tape from the approx time and area you said it happened at then they won't pay, but if they do find the incident on the tape, then they pay....at least that was how it was for my friend when it happened to her, they paid.

make a mental note of the people you see not putting their carts in the corral, remember the car. then when you pull in and their car is there take action, run a cart into it or dump an ashtray on the hood or in the seat.
