Is it legal in NY state for a landlord to restrict the use of dumpsters in an apartment complex over the weekends?
She tells us to keep it in the apartment or in the basement until monday.

the answer to to your question is it depends on what your lease says. Contract Law (your lease) supercedes statutory law in most cases. If your lease gives them the right to do so then yes they can. If it doesn't address the matter they might still be able to as they would argue it is a health and safety issue.

That issue should be covered in your written rental / lease agreement; if it is specified no trash until Monday.

If not then it is probably non-enforceble.

If it is REALLY a BIG deal to you, then talk to the landlord,if you can live with it then just let it go.

Unfortunately, landlords have ways of making your life miserable if you "poke" them.

Say for instance that your sink backs up and the agreement says that the landlord has 48 hours to repair it. They can jump right on it or string it out and stay within the agreement.

It just seems like it is not worth the hassle!

you should get a 48 hour notice of changes so you can be prepared..
but if you have an animal problem or human problem..
with garbage diving..it can be a very dangerous situation..

check your local laws... but some very dangeorus animals and humans included go for garbage..
we had a fireman bite by a "dumpster diver" when the person in the dumpster lit a fire to keep warm..

That's disgusting and should be against the law. Plus, she doesn't own the dumpster, she probably pays for it. But that's what it is there for!

Maybe you can leave it on her doorstep and she can toss it out herself on Monday.
