I've been working at Taco Bell on the south side of Indianapolis (just opened) for almost a month, working days, which was what I was told I would be doing, and just when I was starting to like it, a manager told me I had to change my hours. If I wasn't riding the bus I would but I have no way of getting there and I don't know anyone I can get a ride from. But here's the problem: the manager told me that if I can't get a way to and from work then I can't get schuduled in. I think it's unfair they're denying me hours. Is there anything I can do?

Yeah, quit. It's Taco Bell. You'll get a better job.

Well I would think that a company like Taco Bell would work with you on your schedule but they don't have to. I would try talking to his superior and explain the situation and that you were told when hired it was for mornings. If that doesn't work you can contact their corporate office and lodge a complaint. Alot of bigger companies don't like to be known as being inflexible and maybe that would work. You need to think of the ramifications too. The manager could get an attitude about you going over his or her head and make it their mission to get you to quit. All in all I would try to talk to the manger in question and see if they will bend a little for you and if not then leave and find a job that fits your schedule better.

That's a tough one. You probably need to do some research in Indiana's state employment laws as well as federal laws. I think a lot of what they can and can't do depends on your "status" (i.e. are you full-time or part-time, are you on a 90-day trial). Obviously if you are a full-time employee and there is no "trial" period you have more protection from the law. Unfortunately, part-time workers don't get the same level of protection.

I will tell you one thing, just because your manager tells you something, it is not necessarily true that what he is doing is legal. When I worked retail, I saw so many things happen that were blatant violations of employees' rights. Many of these managers are put out there, but are not given and proper training as to what they can and cannot do (legally). Do your research; if you feel strongly about it, you can get some free legal advice. In the meantime, play nice before you know whether you can rock the boat.

You left out a lot of information for potential solutions. Fast food places have inherent scheduling problems due to their hours of operation and the typical youthful work force. You must have known that. Do you really want to work there? If so, talk to the manager, face to face, heart to heart. Have you talked with other employees about switching shifts? No matter where you work, you are ALWAYS going to need a ride. Taking a job across town, using only public transporation, doesn't leave you with many options. Too many things could go wrong to interfere with your obligations at work.

I don't know the labor laws in Indy but here in Florida the boss can fire you without cause. I would try and resolve this with the manager but knowing Taco Bell like i do it's not going to matter. You are a expendable employee and they would not hesitate to fire you. When that happens just look for a better job.

Is there another manager or assistant you could explain your situation to? Perhaps if you gave them a copy of the bus schedule they could work with you on it.

No, unfortunately you have no recourse. A company can control the hours an employee works.

Just try to see if anyone will give you a ride.
