with remote assistance using windows messenger, you can see their screen(with their permission) and even take control, and move their mouse(with their permission) is there any way you can do that without their permission. if there is tell me how, and if there is, tell me how to prevent that from happening.

The only way you could force the use of Remote Assistance would be if you were in a Domain environment, not a Workgroup. You would do this with the use of GPOs (Group Policy Objects) within Active Directory from a server running as a Domain Controller. Only availabe in Server 2000 or 2003.
